Membership Terms and Conditions – Contract & Casual Memberships
Excluding Limited Access Membership
Welcome to Absolute Weights and Fitness. This document explains the Terms and Conditions associated with being a member here.
1. What do you agree to?
You’re signing up to be a member of Absolute Weights and Fitness. That means you:
Have a membership that is governed by the following terms and conditions.
Agree to pay your fees weekly, fortnightly, or monthly (as you have specified) until you cancel your membership.
Agree to our club rules and etiquette. Our membership guidelines show the whole club’s rules and etiquette.
2. What your membership gives you
You will receive an initial fitness consultation and 24/7 access to our club equipment and facilities for your fitness, and access to our small group training classes if these are included in your membership.
3. Access to the club and unauthorised access
Please look after your electronic key tag and do not let anyone else use it. If you bring a non-member to the gym outside of the advertised staffed hours, you agree to pay $200 per person. This fee will be direct debited from your account immediately.
You agree to pay the current key tag replacement fee if you lose your key. The replacement fee is $15.00.
4. Membership cancellation and other fees
You can cancel any time by giving us 14 days’ notice (just remember that cancelling your direct debit does not cancel your membership). You will not have any cancellation fees if you chose an open-term membership; a minimum-term membership comes with a cancellation fee of $150.
To transfer your membership to another person, you will be required to pay a $150 flat fee, and then the person taking on the membership will be responsible for paying off the remainder of the contracted term balance.
If you fail to make a payment as per the contract, Debit Success (on behalf of Absolute Weights and Fitness Limited) may inform a debt collection or credit reporting agency of the default. If Debit Success refers the debt to a debt collection agency, you agree to pay an additional fee of $25 for handling the default. Additionally, you are liable to pay all costs incurred during the debt collection process, including commission, fees, and costs charged by the debt collection agency, which may be approximately 25% of the outstanding debt.
By signing this contract, you agree to pay an Administration Fee to cover administrative costs associated with your membership. This is outlined in the payment plan section. Debit Success will collect this fee on behalf of Absolute Weights and Fitness Limited.
A reversal fee (for a missed payment) of an amount set out in the Payment Plan section of the contract is payable by you to Debit Success for each reversal of a payment initiated by Debit Success on behalf of Absolute Weights and Fitness Limited.
If this contract continues after the Minimum Term, Debit Success and/or Absolute Weights and Fitness Limited can give notice to increase the instalment amount payable, but the increase will not take effect for at least 30 days following the date of notification. If you are not happy with the increase, you can choose to terminate the contract.
If you request to put your membership on hold during your contracted term there will be a set fee of $40. Memberships can be suspended (put on hold) for a minimum of two weeks and a maximum of eight weeks per year, with a valid reason for the suspension.
5. Club rules
The club’s rules and etiquette are in our membership guidelines, available at reception. The rules keep you and everyone else safe and happy.
We promise to keep you safe by enforcing the laws. We can cancel your membership immediately if you do not follow the rules. Please wear enclosed shoes and/or footwear at all times while in the facility.
If you purposely damage any equipment because you are being careless, we can charge you for the damage.
We do not cancel memberships without serious reasons. If we think your behaviour is negligent, offensive, harmful, illegal, or in breach of our health and safety requirements, we do have the right to enforce a cancellation. The club manager’s decision is final.
6. Staffed hours and assistance
Our staff are available anytime during our advertised hours to help you out. You can also book directly with any of our personal training team.
Our staff and personal trainers are not qualified to give medical advice. If you have health or injury concerns, please see a doctor.
You are responsible for using the club safely and caring for your health and property.
7. Unavailability of the facility
Almost always, we do everything we can to make sure club facilities are available to you 24/7. At busy times you may have to wait to use the equipment.
If building repairs or natural disasters (or something else we cannot control) mean the club has to close, we’ll do our best to let you know. If the problem is going to last more than 48 hours, we will give you the option of placing your membership on hold.
Should we be forced to close the club due to a government mandate such as a Covid-19 lockdown or any other enforced shutdown from a reputable government, we will place your payments and membership on pause as soon as is practically possible, for the length of the enforced shutdown, and then restart both membership and payments when instructed to reopen. Any lost time in your membership will be added to the end of your term.
8. Additional services
If you want to sign up for additional services offered at the club (like a personal trainer, group training sessions or online coaching), you will need to:
Pay any applicable fees for the additional services on top of your standard membership fees; and
Agree to the terms and conditions that apply to the different services.
9. Your personal information
We may collect information about you, including your personal information (as defined by the Privacy Act 1993), to assist in providing services to you, maintaining your account, and enforcing this membership agreement in any way.
To help us stay in touch to meet our side of this agreement, please tell a staff member if any of your contact details should change.
The club may hold your details, Absolute Weights and Fitness Limited. You can ask for a copy and make corrections at any time.
We promise not to pass on your details to any third party other than for credit checks, administration, payment processing, or debt collection, if we are required by law to do so, or if any authorised request is made from a government department or law enforcement agency.
We will ask if we want to use your details for marketing purposes.
